What happens to my will and legal documents when a law firm closes?

 

It is always a sad and pressing time for all involved when a law firm decides to close its doors, and this is a scenario that Pudsey Legal are facing following the announcement of their pending closure on 31st October 2024.  

 

We understand that they are doing all they can to contact their existing clients to advise what will happen with their files, deeds, Wills and any other documents they may be holding but as a client it can be a stressful and emotional time waiting on correspondence from them. Here at JWP Solicitors, we can help with guidance, advice and retrieval of your files and can discuss a way forward for your case. Below are some answers to common questions that are asked:

 

What happens to my Will when a firm closes?

 

Your current firm should contact you to discuss whether you want to collect your documents to store elsewhere or whether your documents are going to be transferred to another firm.

 

What if my file is ongoing?

 

Again, your current firm should contact you to advise of their closure and provide you with your file to take to another firm or request that your new Solicitor requests the file from them. The current firm may be able to recommend a new firm, but you are free to ‘shop’ around to find a Solicitor that suits you and your needs. Will I have to pay for storing my documents?

 

Here at JWP Solicitors we do not charge for storing your documents and we offer a free Will review service when storing new Wills that haven’t been prepared by one of our Solicitors.

 

Do I have to have a new Will written?

 

No, a new Will is not always required but as part of the service of storing your Will we will review your Will free of charge and provide you with honest, clear advice around inheritance tax, care home fee planning and potential claims against your estate. If your Will does need to be changed, we will provide clarity as to costs and timescales.
